Navigating the Complexities of Wyoming Wrongful Death Lawsuit

Losing a loved one is a life-altering event that leaves a void no legal action can truly fill. When that loss is caused by the negligence of another, the grief is often compounded by a sense of injustice and uncertainty about the future.

At Ramos Law, we’re not just lawyers; we’re people who understand trauma from the inside out. Our founder, Dr. Joseph Ramos, is both an emergency room doctor and a trial attorney. He’s stood at bedsides during life’s worst moments. He knows what loss looks like. And now, we bring that same urgency, compassion and precision into the courtroom, fighting for Wyoming families who deserve answers and accountability.

Our Difference is Our Strength

We’re not your typical law firm. And that’s a good thing.

Because Wyoming follows a modified comparative fault system, the defense will often attempt to shift blame to the deceased. We counter these tactics with meticulous evidence collection and Dr. Ramos’s medical-legal insight to prove liability and maximize your recovery.

But here’s what really sets us apart in Wyoming:

  • We treat you like family, not a case file
  • We understand rural life, hard work and tight-knit communities
  • We prepare every case like it’s going to trial
  • We aren’t afraid to stand up to big insurance companies
  • We communicate clearly, no legal jargon, no runaround

We provide compassionate support to our clients and rigorous, trial-focused advocacy against those responsible for their loss

Compassionate to Our Clients. Fierce Against Our Opponents

You’re going through one of the hardest chapters of your life. You deserve a legal team that listens, supports and shows up for you.

With us, you’ll get:

  • Honest conversations, even when they’re hard
  • A team that checks in, not just checks boxes
  • Guidance through every step of the legal process

But when it comes to the other side? We don’t back down.

Insurance companies and corporations often try to minimize wrongful death claims, especially in states like Wyoming where distances are long and accountability can feel far away. We make sure your voice is heard loud and clear.

Types of Wrongful Death in Wyoming

Under Wyoming law, a wrongful death occurs when someone loses their life due to another party’s negligence, recklessness or intentional act. These cases can arise from:
  • Negligent actions
  • Unsafe conditions
  • Failure to follow safety regulations
  • Medical errors
  • Reckless or impaired behavior
Wyoming’s wrongful death laws are unique, including how claims are filed and who may recover damages. That’s why having a team that understands both the legal and human side of these cases is critical.

Common Wrongful Death Cases We See in Wyoming

Wyoming’s industries, highways and lifestyle create specific risks. Some of the most common wrongful death cases we handle include:
  • Oilfield and energy sector accidents
  • Highway crashes on I-80, I-25 and rural roads
  • Trucking and commercial vehicle collisions
  • Construction and industrial accidents
  • Medical malpractice and hospital negligence
  • Defective products and equipment failures
  • Agricultural and ranch-related incidents
No matter how it happened, your loss matters, and we’re here to help you pursue justice.

Workplace Fatalities in Wyoming

Hard Work Shouldn’t Cost a Life. But in Wyoming, It Too Often Does Wyoming is built on grit. Oilfields. Ranches. Construction sites. Long highways. Tough jobs that keep the state running. But those same industries also come with real risk. According to the Wyoming Department of Workforce Services:
  • 37 workers lost their lives on the job in 2024
  • Over half (51.4%) of all workplace deaths in 2024 were caused by transportation incidents, including highway crashes and vehicle-related accidents
Let that sink in: In Wyoming, the most dangerous part of the job is often just getting there.

Fatal Transportation Incidents

The Road Is One of the Most Dangerous Workplaces in Wyoming

From long-haul truck drivers on I-80 to oilfield workers traveling between remote sites, transportation is a daily reality for Wyoming workers… and a deadly one.

The data is clear:

  • 51.4% of all workplace deaths in 2024 were transportation-related
  • In 2023, that number was even higher—66.7% of all fatal workplace incidents

These aren’t just “car accidents.” They include:

  • Commercial trucking crashes
  • Highway collisions on rural and interstate roads
  • Workers struck by vehicles or heavy equipment
  • Rollovers in harsh weather conditions
  • Fatigue-related and long-distance driving incidents

In a state where distances are long, weather changes fast and roads can be unforgiving, transportation risks are part of the job, but that doesn’t mean they should be ignored.

When companies fail to enforce safety protocols, push unrealistic schedules or neglect proper training, these tragedies become preventable.

Wyoming’s Most Dangerous Industries

The data from the Census of Fatal Occupational Industries (CFOI) shows a clear pattern that certain industries carry a heavier burden:
  • Natural resources & mining (including oil & gas): nearly 30% of all deaths in 2024
  • Transportation & warehousing: over 20% of fatalities
  • Construction: consistently among the top industries for fatal injuries
In prior years, the numbers tell a similar story:
  • In 2023, 37.8% of deaths occurred in natural resources & mining
  • Two-thirds (66.7%) of fatalities were transportation-related
This isn’t random. It reflects the reality of how Wyoming works and the risks workers face every single day. Why This Matters for Your Family When a workplace fatality happens, it’s not just a statistic. It’s a father who didn’t come home. A mother who never walked back through the door. A family left trying to figure out what comes next. And here’s the hard truth: Not all workplace deaths are “accidents.” Some are caused by:
  • Unsafe working conditions
  • Lack of proper training or supervision
  • Equipment failures
  • Negligence by third parties (like trucking companies or contractors)
When that happens, your family may have the right to pursue a wrongful death claim beyond workers’ compensation.

What Kind of Damages are Caused by Wrongful Death

A wrongful death doesn’t just take a life. It impacts everything connected to it. We fight to recover damages for:
  • Funeral and burial expenses
  • Medical bills related to the final injury or illness
  • Loss of income and financial support
  • Loss of companionship, care and guidance
  • Emotional pain and suffering
In Wyoming, these damages are meant to help families rebuild, but also to hold the responsible party accountable.

Types of Cases We Handle

At Ramos Law, we handle wrongful death cases across a wide range of circumstances, including:
  • Auto accidents
  • Trucking accidents
  • Workplace injuries
  • Medical malpractice
  • Aviation incidents
  • Premises liability (slip and fall, unsafe property conditions)
  • Product liability
If someone else’s actions led to your loss, we’re ready to step in and stand up.

Kinds of Wrongful Death Compensation You’re Entitled To

It’s Not About “Putting a Price” on a Life. It’s About Protecting the People Left Behind.

No amount of money can ever replace your loved one. We know that. You know that. And Wyoming law recognizes that too. But what compensation can do is give your family stability, accountability and the ability to move forward without financial devastation. At Ramos Law, we fight to recover every dollar your family is entitled to. Because your future matters.

Economic Damages (The Financial Impact You Can Measure)

These are the tangible losses that come with losing a loved one:

  • Medical expenses related to the final injury or illness
  • Funeral and burial costs
  • Lost income and future earnings your loved one would have provided
  • Loss of benefits like health insurance, retirement or pensions
  • Loss of household contributions (everything from childcare to ranch work)

In a state like Wyoming, where families often rely on each other in very real, hands-on ways, these losses can be especially significant.

Non-Economic Damages (The Loss You Feel Every Day)

Some losses can’t be calculated on a spreadsheet. But they still matter deeply. Under Wyoming law, families may seek recovery for the ‘loss of probable future companionship, society, and comfort

  • Loss of companionship, love and emotional support
  • Loss of guidance, mentorship and parental care
  • Emotional pain and suffering experienced by surviving family members

We take the time to understand your story. Because these damages deserve to be fully seen and fully fought for.

Punitive Damages (Holding Wrongdoers Accountable)

In cases involving extreme negligence or reckless behavior, Wyoming courts may award punitive damages. These aren’t just about compensation. They’re about sending a message: What happened to your family should never happen again.

Who Can Recover Compensation in Wyoming?

Wyoming has specific rules about who can bring a wrongful death claim and who can recover damages. Typically, this includes close family members such as spouses, children and sometimes parents.

We’ll walk you through exactly how the law applies to your situation clearly, simply and with your best interests at heart.

We Fight for What Your Family Deserves

Insurance companies often try to minimize wrongful death claims, especially when families are grieving and overwhelmed.

That’s not how we operate.

We build every case with precision, backed by medical insight and real-world experience, so your family gets the full compensation you deserve, not a quick settlement that falls short.

Because this isn’t just a case. It’s your family’s future.

Helping Wyoming Find Justice

Wyoming is built on resilience, hard work and community. We’re proud to stand with the people who make this state strong.

When tragedy strikes, we step in. Not just as lawyers but as advocates, supporters and fighters for what’s right. Because in Wyoming, people take care of each other. And at Ramos Law, that’s exactly what we do.

Wyoming Wrongful Death FAQ's

Wyoming does things a little differently than most states.

Under Wyoming Statute § 1-38-102, only a “wrongful death representative” can file the lawsuit—not individual family members directly. That representative is appointed by the court and brings the case on behalf of surviving family members, such as spouses, children or parents.

In plain English: You still benefit from the case, but there’s a specific legal process to get it started. That’s where having the right legal team matters.

Wyoming law defines wrongful death very clearly.

According to Wyoming Statute § 1-38-101, a wrongful death occurs when someone dies due to a “wrongful act, neglect or default” that would have allowed them to file a personal injury claim if they had survived.

That means cases can arise from:

  • Car and truck accidents
  • Medical mistakes
  • Workplace incidents (including oilfield and ranch accidents)
  • Dangerous property conditions

If negligence caused the loss, there’s a strong chance you have a case.

Wyoming’s statute of limitations for wrongful death is generally two years from the date of the decedent’s passing (W.S. § 1-38-102). This timeline is shorter than many other personal injury claims, making early legal intervention essential to preserve your family’s rights. There are very few exceptions.

That might sound like a long time, but building a strong case takes time, especially in complex cases involving medical records, accident reconstruction or multiple parties.

The sooner you start, the better protected your family is.

Wyoming gives courts broad authority to award damages that are “fair and just.”

Under Wyoming Statute § 1-38-102(c), compensation may include:

  • Financial losses (income, benefits, support)
  • Funeral and medical expenses
  • Loss of companionship, society and comfort
  • In some cases, punitive (exemplary) damages

The law specifically allows damages for the “loss of probable future companionship, society and comfort.”

Translation: Wyoming recognizes that this loss is not just financial. It’s deeply personal.

This is one of the most important (and most misunderstood) questions.

A critical component of W.S. § 1-38-102(b) is the protection of recovery funds. In Wyoming, wrongful death awards are generally distributed to the beneficiaries and remain exempt from the debts and liabilities of the deceased’s estate, ensuring the financial support reaches the family as intended.

That means:

  • Creditors generally cannot take these funds
  • The money goes directly to surviving family members
  • It’s meant to support you, not pay off past obligations

This is a powerful protection under Wyoming law and one many families don’t realize they have.
