Colorado Auto Accident Laws Every Loveland Driver Should Know

Colorado law gives injured crash victims important legal protections. But those rights don’t last forever. Understanding a few key laws can help you make informed decisions after an accident.

Colorado Is an At-Fault State

Colorado follows a traditional fault-based insurance system. That means the driver who caused the crash is generally responsible for the damages resulting from the collision.

Depending on your case, you may pursue compensation through:

  • The at-fault driver’s insurance company
  • Your own insurance coverage (when applicable)
  • A personal injury lawsuit

You Generally Have Three Years to File an Auto Accident Lawsuit

Under C.R.S. § 13-80-101(1)(n)(I), a lawsuit for bodily injury or property damage arising from the use or operation of a motor vehicle generally must be filed within three years after the claim accrues. Under C.R.S. § 13-80-108(12), the claim accrues when you know or reasonably should know both that you suffered injury or damage and what caused it. Other claims or circumstances may have different deadlines, so speak with an attorney promptly rather than assuming you have three years from the crash date. 

Special deadlines may apply to claims involving government entities or public employees. 

Under C.R.S. § 24-10-109, a person asserting a claim against a public entity or public employee generally must provide written notice within 182 days after discovering the injury. Missing this notice deadline can affect your ability to pursue a claim. If your accident involved a government vehicle, public employee or other public entity, contact an attorney promptly to determine which deadlines apply. 

Colorado Uses Modified Comparative Negligence

Colorado follows a modified comparative negligence rule under C.R.S. § 13-21-111. If you share responsibility for a crash, your damages may be reduced by your percentage of negligence. You generally cannot recover from a defendant if your negligence is equal to or greater than that defendant’s negligence.

For example:

  • If your damages total $100,000 and you are 20% responsible while the other driver is 80% responsible, your damages may be reduced to $80,000.
  • If you and the other driver are each 50% responsible, you generally cannot recover from that driver.

Fault can be more complicated when several parties are involved. Our attorneys review the available evidence and challenge fault assessments that do not reflect what happened.

Colorado Requires Minimum Auto Insurance Coverage

Every Colorado driver must carry minimum liability insurance, including:

  • $25,000 for bodily injury to one person
  • $50,000 for bodily injury per accident
  • $15,000 for property damage

Unfortunately, serious injuries often exceed these minimum limits. That’s why it’s important to explore every available source of compensation, including additional insurance policies that may apply.

Uninsured and Underinsured Motorist Coverage Matters

Not every driver carries enough insurance. If the at-fault driver has no insurance (or not enough to cover your losses) your own uninsured/underinsured motorist (UM/UIM) coverage may provide additional protection.

Call 911 when someone is injured or there is an immediate danger; otherwise, follow the responding agency’s reporting instructions. 

An official crash report creates an important record that may later support your insurance claim or lawsuit.

The moments after a car accident are often a blur. You may be shaken up, worried about your passengers or unsure whether you’re seriously hurt. It’s easy to overlook important steps that could affect both your recovery and your ability to pursue compensation later.

  1. Put Safety First: If it’s safe to do so, move your vehicle out of traffic to help prevent another collision. Turn on your hazard lights and check yourself and your passengers for injuries. If anyone is seriously hurt, don’t attempt to move them unless there’s an immediate danger, such as a fire.
  2. Call 911: Even if the crash seems minor, contact law enforcement. Officers from the Loveland Police Department, Larimer County Sheriff’s Office or Colorado State Patrol can investigate the scene, document evidence and prepare an official crash report. That report often becomes one of the most important pieces of evidence in an insurance claim or lawsuit.
  3. Accept Medical Care: If emergency responders recommend that you be evaluated, listen to them. Many injuries (including concussions, internal bleeding and spinal injuries) don’t always produce immediate symptoms. Adrenaline can temporarily mask pain, making you feel better than you actually are. If you aren’t transported from the scene, schedule a medical evaluation as soon as possible. Early diagnosis protects both your health and your legal claim.
  4. Exchange Information: Collect the following from every driver involved: Name and contact information, driver’s license number, insurance company and policy information, license plate number, and vehicle make and model. Remain polite but avoid discussing fault. Even saying “I’m sorry” can later be taken out of context.
  5. Document Everything: If you’re physically able, use your phone to photograph: Vehicle damage, the entire accident scene, road conditions, traffic signs and signals, skid marks, debris, weather conditions, and visible injuries. The scene will change quickly after vehicles are removed, making photographs incredibly valuable.
  6. Talk to Witnesses: Independent witnesses often provide the most credible account of what happened. If someone saw the collision, ask for their name and contact information before they leave.
  7. Notify Your Insurance Company: Report the accident promptly, but keep your statement factual. Avoid speculating about your injuries or accepting blame before all the facts are known.
  8. Don’t Give a Recorded Statement to the Other Driver’s Insurance Company: Insurance adjusters may sound friendly, but their job is to protect the insurance company’s financial interests, not yours. Before providing a recorded statement or signing any documents, speak with an experienced car accident attorney.
  9. Follow Your Treatment Plan: Continue attending medical appointments, follow your physician’s recommendations and complete physical therapy if prescribed. Gaps in treatment are frequently used by insurance companies to argue that someone wasn’t seriously injured.
