What is considered a false background check under the Fair Credit Reporting Act (FCRA)?
A false background check occurs when a consumer report contains inaccurate, outdated or misleading information that harms your employment, housing or other opportunities.
Under the Fair Credit Reporting Act, background check companies are legally required to ensure accuracy. The law states:
“Whenever a consumer reporting agency prepares a consumer report it shall follow reasonable procedures to assure maximum possible accuracy…”
— 15 U.S.C. § 1681e(b)
If a report includes incorrect criminal records, mixed files or outdated information, it may violate federal law.
Can I sue for an inaccurate background check that cost me a job?
Yes. If an inaccurate background check caused you to lose a job or employment opportunity, you may have a legal claim under the FCRA.
You can pursue compensation if:
- The background check contained errors
- The reporting agency failed to correct them
- The employer relied on that incorrect information

What are my rights if I’m denied a job because of a background check?

How long do background check errors stay on my record?
It depends on the type of information, but many negative items cannot legally be reported after a certain period.
For example:
- Most non-conviction records (like arrests) cannot be reported after 7 years
- Bankruptcies may be reported for up to 10 years
- Some criminal convictions may be reported indefinitely, depending on state law
However, even if something is legally reportable, it must still be accurate and up to date. Outdated, duplicated or incorrect entries may violate the FCRA regardless of timing.
