Types of Boating Accident Cases We Handle
Ramos Law handles boating injury claims involving collisions, personal watercraft, propellers, capsizing, wakes, impaired operators, rentals and tours, and defective boats or equipment. Boating accidents can happen on crowded reservoirs, quiet mountain lakes and fast-moving rivers. Depending on the circumstances, responsibility may rest with a boat operator, vessel owner, rental company, manufacturer or another party. Ramos Law can evaluate a range of boating-related injury claims, including:
Boat Collisions
When two boats collide, passengers can be thrown against hard surfaces, ejected into the water or struck by equipment. Speed, operator inattention, unsafe maneuvers, poor visibility and failure to follow navigation rules may contribute to a crash.
Personal Watercraft and Jet Ski Accidents
Jet Ski and personal watercraft collisions with boats, other personal watercraft, swimmers or fixed objects can cause severe injuries because these vessels travel at high speeds and make sudden turns.
Propeller and Ejection Injuries
A person who falls overboard may be struck by a moving vessel or its propeller. These incidents can cause catastrophic lacerations, amputations, blood loss and other life-threatening trauma.
Capsizing and Boat Swamping
Sudden weather changes, rough water, overloading, unsafe maneuvers or improper weight distribution can cause a vessel to capsize or take on water. Passengers may suffer impact injuries, hypothermia or drowning.
Wake-Related Accidents
A boat’s wake can destabilize another vessel or throw passengers off balance. Operators may be responsible when they create dangerous conditions through unsafe speed, distance or maneuvering.
Boating Under the Influence
An operator who causes a boating accident while impaired by alcohol or drugs may face a personal injury claim in addition to any criminal or boating-law consequences. Alcohol and drugs can impair judgment, reaction time and coordination.
Rental Boat and Tour-Related Accidents
Some incidents involve poorly maintained rental vessels, inadequate safety instructions, unsafe equipment or negligent operation by a commercial guide. Liability depends on the facts, the parties’ responsibilities and applicable law.
Defective Boats and Equipment
A mechanical failure, defective steering system, faulty engine component or malfunctioning safety equipment may contribute to an accident. Depending on the circumstances, a manufacturer, distributor, repair provider or maintenance company may be responsible.
Injuries from Boating Accidents
A boating accident can cause injuries ranging from painful bruises to permanent disability. The force of a collision, a fall onto a hard surface, an impact with a propeller or time spent in cold water can make these incidents particularly dangerous.
Common boating accident injuries include:
- Traumatic brain injuries: Concussions and more severe brain injuries can occur when someone strikes a vessel, another object or the water.
- Spinal cord and back injuries: A sudden impact or forceful ejection can damage the spine and may result in lasting mobility limitations.
- Broken bones and orthopedic injuries: Fractures, dislocations and torn ligaments can require surgery and rehabilitation.
- Severe cuts and amputations: Propeller injuries and other machinery-related trauma can cause extensive tissue damage and permanent impairment.
- Drowning and near-drowning injuries: Submersion can cause oxygen deprivation and potentially permanent brain damage.
- Hypothermia: Cold water can rapidly impair coordination and the body’s ability to function, particularly in Colorado’s mountain environments.
- Internal injuries and blood loss: Blunt-force trauma or penetrating injuries can cause serious damage even when external symptoms are limited.
- Burns and smoke inhalation: Fires, fuel-related incidents and engine malfunctions can cause additional injuries.
The Long-Term Effects of a Boating Injury
Serious boating injuries can require emergency treatment, surgery, rehabilitation, medication and ongoing medical care. Some people may also face lost income, difficulty returning to work, emotional distress or limitations on activities they once enjoyed.
Ramos Law’s medical and legal perspective can help our team evaluate the broader effects of an injury when assessing a potential claim.

How Common Are Boating Accidents in Colorado?
Nationally, the U.S. Coast Guard recorded 3,887 recreational boating incidents, 2,170 nonfatal injuries and 556 deaths in 2024. These are national figures, not Colorado totals.
Colorado’s lakes and reservoirs draw boaters from across the state, and the risks are real. Accidents may involve vessel collisions, capsizing, falls overboard, dangerous wakes or propeller injuries.
Colorado Parks and Wildlife (CPW) maintains boating-safety information, incident-reporting requirements and boating regulations. Its reporting rules cover qualifying incidents involving a death or disappearance, an injury requiring medical treatment beyond first aid, or property damage exceeding $2,000 or a complete vessel loss.
For current statewide boating accident totals, fatalities and injuries, consult the latest available CPW and U.S. Coast Guard recreational boating reports. These sources distinguish reportable boating incidents from broader water-related deaths, which may include swimming, rafting, kayaking and other activities.

Colorado Boating Laws and Your Rights
Colorado law establishes responsibilities for boat operators and requirements for reporting certain accidents. Violations may be relevant when investigating how an incident occurred, although a statutory violation does not automatically establish civil liability.
What Counts as Careless or Reckless Boat Operation in Colorado?
Under C.R.S. § 33-13-108, Colorado prohibits careless or imprudent vessel operation that endangers people, property or wildlife, as well as reckless operation. The statute includes examples of unsafe wake crossing, weaving through boat traffic and operating too close to another vessel at an unsafe speed.
What Must You Do After a Boating Accident in Colorado?
Under C.R.S. § 33-13-109, an operator involved in a collision or other casualty must, when safely possible, provide reasonable assistance to affected people and provide identifying information. Operators and owners must also comply with applicable accident-reporting rules.
CPW says a boating accident report must generally be filed within five days when a qualifying incident involves a death or disappearance, an injury requiring medical treatment beyond first aid, or property damage exceeding $2,000 or complete vessel loss. A death or disappearance must also be reported immediately to the nearest law enforcement officer.
Situation | What Colorado requires | When |
Any collision or casualty | Give reasonable assistance and identifying information (C.R.S. § 33-13-109) | When safely possible |
Death or disappearance | Notify the nearest law enforcement officer and file a CPW report | Immediately; report within five days |
Injury needing treatment beyond first aid | File a CPW boating accident report | Within five days |
Property damage over $2,000 or complete vessel loss | File a CPW boating accident report | Within five days |
What Are Colorado’s Boating Under the Influence Laws?
Colorado law prohibits operating a vessel while impaired by alcohol or drugs, and evidence of impairment can matter when determining fault in an injury claim. Colorado’s legal limit for boat operators is 0.08 BAC. [CONFIRM BAC LIMIT AGAINST C.R.S. § 33-13-108.1 BEFORE PUBLISHING] Nationally, alcohol was the leading known contributing factor in fatal boating incidents in 2024, linked to 92 deaths (20% of fatalities), according to the U.S. Coast Guard.
See the official Colorado boating statutes and regulations for the current boating-law handbook and applicable provisions.
How Does Colorado’s Comparative Negligence Law Work?
In Colorado, you generally cannot recover damages if your negligence is equal to or greater than the negligence of the party you are seeking recovery from, subject to the statute’s terms. Under C.R.S. § 13-21-111, a person’s own negligence can affect recovery in a civil negligence case.
The facts of a boating accident matter. An injured passenger should not assume that they have no claim simply because someone alleges they contributed to the incident.
What Are the Deadlines for Filing a Boating Accident Claim?
Colorado sets different filing deadlines for different types of boating injury claims, and special rules can apply to claims against government entities and to wrongful death claims. The deadline for a specific lawsuit also depends on the parties involved and other circumstances.
Promptly obtaining legal advice can help protect evidence and clarify which deadline applies. Do not assume that a boating accident follows the same deadline as every other personal injury case.
What Should You Do After a Colorado Boating Accident?
If you are involved in a boating accident, prioritize safety and medical care.- Get to safety and call for help. Contact emergency services when someone is injured, missing or in danger.
- Seek medical attention. Some serious injuries, including head trauma and internal bleeding, may not be immediately apparent.
- Report the incident as required. Follow applicable CPW and law enforcement reporting requirements.
- Document what happened. If it is safe to do so, preserve photographs, video, witness information, vessel details and relevant communications.
- Keep records. Save medical records, bills, receipts, insurance correspondence and documentation of missed work.
- Be cautious with statements. Avoid speculating about fault before the facts are known, and carefully review requests for recorded statements or releases.
- Consider legal guidance. An attorney can help evaluate potential claims, identify responsible parties and explain applicable deadlines.

Colorado Car Accident FAQs
Can I sue if I was injured in a Colorado boating accident?
Yes, you may be able to sue if another party’s negligence or wrongful conduct caused your injuries in a Colorado boating accident. The available options depend on the evidence, the parties involved and applicable law.
Who can be held responsible for a boating accident?
Depending on the facts, responsibility may involve a boat operator, vessel owner, rental company, tour operator, manufacturer, maintenance provider or another negligent party. More than one party may share responsibility.
What if the boat operator was drinking?
If the boat operator was drinking, evidence of impairment may be relevant to determining fault in your injury claim. Operating a vessel under the influence can also lead to separate legal consequences. A civil injury claim is evaluated according to the facts and applicable law.
Do I have to report a boating accident in Colorado?
Yes, Colorado generally requires a report within five days when an incident involves a death or disappearance, an injury requiring medical treatment beyond first aid, or property damage exceeding $2,000 or complete vessel loss. Additional immediate notification requirements apply to deaths and disappearances.
What if I was a passenger and the boat operator caused the accident?
You may be able to pursue a claim if the operator’s negligence caused your injuries. Passengers should preserve available evidence and seek medical attention, even if the operator is a friend or family member.
Can I file a claim if I was injured on a rented boat or Jet Ski?
You may have a claim after a rented boat or Jet Ski injury, because a rental agreement does not automatically resolve every potential claim. The facts may warrant investigating the operator’s actions, the rental company’s procedures, equipment condition and safety instructions.
What if I was injured by a boat's propeller?
If a boat’s propeller injures you, seek emergency medical care immediately, then preserve incident details and witness information if you can do so without delaying treatment. Propeller injuries can cause severe lacerations, blood loss, amputations and other life-threatening harm.
Can I recover damages if I was partly at fault?
You may still recover if your share of fault is less than the other party’s. Colorado’s comparative negligence law may reduce your recovery based on your share of fault, and the statutory threshold can bar recovery. The specific facts and allocation of negligence matter.
What compensation may be available after a boating accident?
Depending on the claim, recoverable damages may include medical expenses, lost income, loss of future earning capacity, pain and suffering, and other legally recognized losses. The available categories depend on the facts and applicable law.
How long do I have to file a boating accident lawsuit in Colorado?
There is no single deadline. Colorado applies different limitation periods depending on the type of claim, and special rules may apply, so contact an attorney promptly rather than relying on a general deadline.
What if a boating accident caused a death?
Certain surviving family members or a representative of the estate may have legal options under Colorado’s wrongful death or related laws. Eligibility, deadlines and recoverable damages depend on the circumstances.
What evidence can help support a boating accident claim?
Useful evidence may include photographs, videos, witness statements, vessel registration details, incident reports, medical records, repair records, insurance information and documentation of lost income. Evidence can disappear quickly, so preserve it as soon as practical.
Can I bring a claim if I was injured on a Colorado river rather than a lake?
You may have a claim for an injury on a Colorado river, because location alone does not determine whether a claim is available. Liability depends on the activity, the parties involved, the cause of the incident and applicable law.

I can’t say enough about Joanna DeRosia and her paralegal, Lydia! Joanna and Lydia were professional, communicated every step of the way and made me feel like my case was their only one. (I knew it was just one of many!) I was traumatized and anxious but as soon as Joanna took my case, I knew I could trust her to work in my best interest. She’s the best!Posted on Google![]()

It is sometimes hard to identify the most important people in your life until that moment when you most need them – they show up! After slamming head first into the side of a car and watching as the rear wheel rolled over my head (helmeted fortunately) I had no idea what the future would look like. What I least expected was that my Brother’s urging that I call RAMOS LAW would be as important and pivotal to my long term Well-being as the actions of the EMT’s, the Emergency staff, the Surgeon and Recovery professionals have been to my Physical recovery. The attorney at RAMOS LAW who took my case, Joanna DeRosia, and her ever-available right hand paralegal, Lydia Beverly, have been my ALLIES as they have navigated what for me is the confusing and potentially contentious effort to hold Insurers to account on my behalf. Their explanations of the process as it has unfolded have always left me with clarity and with TRUST that I would recover physically AND I would also be made FINANCIALLY WHOLE! But for the unflagging efforts of my Allies, MY TEAM at RAMOS LAW, I am clear that being strangled with an over-whelming burden of MEDICAL DEBT would be My Reality! I am and will remain forever grateful to the many who carried me through this challenging experience, especially including my Allies at RAMOS LAW. Gary S RayPosted on Google![]()

Boat Safety Tips To Keep The Summer Fun And Safe
Many people often underestimate the importance of safety when they are boating. It is similar to people who neglect to wear a bicycle helmet when
