Brain Injury Lawyers Serving All of Wyoming

A traumatic brain injury can happen in an instant, but its effects can last for months, years or even a lifetime. Car crashes, falls, workplace accidents and other traumatic events can cause TBIs that affect memory, concentration, communication, movement and everyday life. At Ramos Law, our Wyoming brain injury attorneys combine legal experience with medical insight to understand how a TBI has changed your life and what may be needed for the future.

Why Choose Ramos Law for Your TBI Case?

Ramos Law was founded by Joseph Ramos, MD, JD, a board-certified emergency physician and attorney. That combination gives our team a different perspective when representing people who have suffered serious injuries.

We don’t simply read a medical record and repeat what it says. We understand how traumatic injuries happen, how they are evaluated in emergency settings and how symptoms can develop or persist after an accident. That medical perspective can be especially important in brain injury cases, where the full impact of an injury may not be apparent immediately.

We Understand Your Injuries

A brain injury can affect far more than a person’s physical health. We work to understand the medical diagnosis, symptoms, treatment, rehabilitation and potential long-term effects of a TBI.

Insurance companies know when a case is being prepared for trial. Our attorneys build cases with litigation in mind from the beginning, including investigating liability, preserving evidence and developing the medical and damages evidence necessary to support a claim.

Brain injury cases can involve complicated medical terminology, multiple providers and long-term treatment. We work to explain what is happening and keep you informed throughout the process.

A TBI can affect spouses, children, caregivers and entire families. We take the time to understand what your injury means for your work, relationships, independence and everyday life.

TBI in Wyoming: What the Data Shows

  • According to a CDC analysis of mortality data from 2016 through 2018, Wyoming recorded 590 TBI-related deaths. Its age-adjusted annual death rate was 32.6 per 100,000 people, the second-highest state rate during that period. These figures include both intentional and unintentional injuries.
  • The Wyoming Department of Health provides information about traumatic brain injuries through its Injury & Violence Prevention Program. Separately, its 2025 HealthStat report lists 5,915 trauma registry records for state fiscal year 2025. This figure covers trauma cases generally and does not represent the number of TBIs in Wyoming.

Common Causes of Traumatic Brain Injuries

A TBI can occur in many different types of accidents. Common causes include:

  • Motor vehicle accidents
  • Truck and commercial vehicle crashes
  • Motorcycle accidents
  • Bicycle and pedestrian accidents
  • Workplace accidents
  • Construction accidents
  • Falls
  • Sports and recreational accidents
  • Premises liability accidents
  • Defective products
  • Assaults and other violent incidents

The CDC identifies falls and firearm-related injuries as leading causes of moderate and severe TBIs, while TBIs can also result from motor vehicle crashes and other traumatic events.

Signs and Symptoms of a Traumatic Brain Injury

Brain injury symptoms can vary significantly depending on the person and the severity of the injury.

Physical Symptoms

  • Headaches
  • Dizziness
  • Nausea or vomiting
  • Blurred or double vision
  • Sensitivity to light or sound
  • Balance problems
  • Fatigue
  • Sleep disturbances

Cognitive Symptoms

  • Memory problems
  • Difficulty concentrating
  • Confusion
  • Slowed thinking
  • Difficulty finding words
  • Problems with planning or decision-making

Emotional and Behavioral Symptoms

  • Irritability
  • Anxiety
  • Depression
  • Mood changes
  • Emotional outbursts
  • Changes in personality
  • Difficulty managing emotions

Not every person with a TBI experiences the same symptoms, and some symptoms may develop or become more apparent after the initial accident. The CDC provides separate guidance for mild TBI and concussion as well as moderate and severe TBI.

Seek medical attention after a suspected brain injury. Call 911 or go to an emergency department immediately for danger signs such as a worsening headache, repeated vomiting, seizures, slurred speech, increasing confusion, weakness or difficulty waking up.

More information can be found on the CDC symptoms and danger-signs page.

How a TBI Can Affect Your Life

A brain injury can affect your work, relationships and independence.

Someone who previously worked full-time may have difficulty returning to the same job. A parent may struggle with tasks that once seemed routine. A person may need help with transportation, household responsibilities, communication or managing finances.

For moderate or severe TBIs, the CDC notes that long-term or lifelong health problems can affect many aspects of a person’s life.

When evaluating a brain injury claim, it may be important to consider:

  • Current medical treatment
  • Future medical care
  • Rehabilitation
  • Occupational and speech therapy
  • Cognitive rehabilitation
  • Lost wages
  • Reduced earning capacity
  • Changes in household responsibilities
  • Long-term care needs
  • Pain and suffering
  • Loss of enjoyment of life
  • Permanent impairment
  • The impact of the injury on family members

A TBI claim should not be evaluated solely by looking at the first emergency-room visit or the initial medical bills. The long-term consequences of the injury may be much greater.

What Makes TBI Cases Different?

Brain injury cases can present unique challenges because the effects of a TBI are not always visible.

A person with a broken bone may have an obvious injury that can be seen on an X-ray. A person with a brain injury may look completely healthy while struggling with memory, concentration, fatigue, emotional regulation or other cognitive symptoms.

That can create challenges when dealing with insurance companies. The absence of an obvious external injury does not necessarily mean a brain injury is minor.

Building a TBI case may require a detailed review of:

  • Emergency medical records
  • Diagnostic testing
  • Neurology records
  • Neuropsychological evaluations
  • Rehabilitation records
  • Therapy records
  • Employment history
  • School records
  • Statements from family members and coworkers
  • Prior medical history
  • Accident reconstruction
  • Witness testimony
  • Insurance coverage
  • Future medical needs

Wyoming TBI & Brain Injury FAQs

Ramos Law handles personal injury claims involving traumatic brain injuries arising from circumstances such as:

  • Car accidents
  • Truck accidents
  • Motorcycle accidents
  • Bicycle and pedestrian accidents
  • Workplace and construction accidents
  • Falls
  • Premises liability
  • Defective products
  • Sports and recreational accidents
  • Serious and catastrophic injuries
  • Wrongful death claims

Workplace injuries may involve workers’ compensation benefits. When a third party is legally responsible for the injury, a separate personal injury claim may also be available. Wyoming law distinguishes workers’ compensation remedies against covered employers from claims against responsible third parties. Every case is different, and whether a legal claim exists depends on the specific facts and applicable law.

A traumatic brain injury is an injury that affects how the brain works and is caused by a bump, blow or jolt to the head or by a penetrating injury. TBIs can range from mild injuries such as concussions to moderate and severe brain injuries.

Yes. A person does not necessarily have to lose consciousness to suffer a traumatic brain injury. Concussions and other mild TBIs can occur without a loss of consciousness.

If you have symptoms following a blow or jolt to the head or another traumatic event, you should seek appropriate medical evaluation.

Symptoms can include headaches, dizziness, nausea, fatigue, balance problems, sensitivity to light or sound, memory problems, difficulty concentrating, confusion, sleep problems and changes in mood or behavior.

Symptoms vary from person to person and may change over time. The CDC provides information on symptoms, treatment and recovery for mild TBI and concussion.

Your health should come first. Seek medical attention and follow your healthcare provider’s instructions.

After an accident, the following steps can help protect your health and document what happened:

1. Seek Medical Attention

A medical evaluation can help identify injuries and create documentation of your condition.

2. Report the Accident

Depending on the circumstances, the accident may need to be reported to law enforcement, an employer, property owner or another appropriate party.

3. Document What Happened

If you are physically able, photograph the accident scene, vehicles, property damage, visible injuries and other relevant evidence.

4. Follow Your Treatment Plan

Attend follow-up appointments and follow recommendations from your healthcare providers.

5. Keep Records

Keep copies of medical records, bills, prescriptions, therapy records and documentation of missed work.

6. Be Careful With Insurance Companies

Insurance adjusters may ask questions about your accident, medical history and injuries. You do not have to navigate complicated insurance questions alone.

At Ramos Law, consultations for personal injury cases are free. For qualifying injury cases, the firm generally works on a contingency-fee basis, meaning you don’t pay attorney fees upfront and the firm is paid from a recovery if one is obtained. Your written fee agreement will explain the contingency fee and how case expenses are handled.

A delayed diagnosis does not necessarily mean that an injury did not occur. Some TBI symptoms can be difficult to recognize immediately, particularly when a person is also dealing with other injuries or the stress of an accident.

Medical records, follow-up evaluations, witness observations and other evidence may help establish the nature and progression of an injury.

A concussion is a form of mild traumatic brain injury. Recovery varies from person to person. Some people recover relatively quickly, while others experience persistent symptoms that require additional evaluation and treatment.

The CDC notes that TBI can have effects ranging from temporary symptoms to long-term or lifelong health problems depending on the severity and circumstances of the injury.

An insurance company’s characterization of an injury does not by itself determine the severity or consequences of a TBI.

Medical records, diagnostic testing, treatment history, expert evaluations and evidence regarding how the injury affects daily life can all be relevant when evaluating a claim.

Wyoming uses a modified comparative-fault system under Wyo. Stat. § 1-1-109. You may recover damages if your share of the total fault is 50% or less, but your compensation is reduced by your percentage of fault. If your share exceeds 50%, recovery is barred.

Depending on the circumstances of the case, a claim may involve damages related to:

  • Medical expenses
  • Future medical care
  • Rehabilitation
  • Lost wages
  • Reduced earning capacity
  • Pain and suffering
  • Permanent impairment
  • Loss of enjoyment of life
  • Other damages recognized under Wyoming law

The damages available in a particular case depend on the facts and applicable law.

Most negligence-based brain injury lawsuits in Wyoming must be filed within four years after the claim accrues under Wyo. Stat. § 1-3-105(a)(iv)(C). Other claims can have shorter deadlines, including wrongful death, assault or battery, and claims involving government entities. Special rules may apply to minors and people with a legal disability. Have an attorney determine the deadline for your specific case promptly.

I had the best experience today, because I was connected with Ronald Castellon during the intake process for a car accident that I was recently in. I called Ramos Law today because I was actually signed on with another local Law Firm, but have had a very bad experience with them because they actually never even get back to me , and have plenty of excuses about they have not reached out to me, etc. Ronald Castellon was extremely compassionate towards my situation that I was not at fault for. He was very considerate towards me from the beginning of the phone call and especially towards the end of our conversation. I felt heard, understood, and I felt like I was going to receive the best care possible for my many injuries that incurred from being hit by another driver while I was parked in a parking lot. I sincerely thank Ronald for being such an incredibly supportive and helpful person to me during the intake process today! He is a huge asset to Ramos Law, and I hope he receives recognition for a job well done! I am so impressed with his dedication to his profession and I am grateful for his great attitude overall throughout the conversations that we had. He made a great impression on me, and it is definitely a good reflection on Ramos Law Firm. Thank you, Ronald

I Dan G. recently worked with Jennifer Reyes from the Property Damage Team at Ramos Law, and I am truly grateful for her support. After my car was totaled in an accident, Jennifer reached out to assist me with negotiating my insurance settlement. She referred me to Total Loss Champions (TLC), and her consistent follow‑up with both me and TLC made the entire process much easier to navigate. Jennifer’s guidance and dedication helped me secure the best possible outcome for my settlement. Thank you, Jennifer, for your professionalism, responsiveness, and genuine care throughout this stressful situation. Your assistance made a significant difference.
