For most cases, however, before we can discuss your credit issue you must first file a formal dispute with the credit bureau and your request for correction be denied. This first step is required for building a legal case. You must be able to show that you have already tried to resolve the issue directly with the credit bureaus and/or data furnishers and were unsuccessful. We cannot pursue legal action when errors are resolved after filing your first dispute.

- Obtain a free copy of your credit report: AnnualCreditReport.com
- Analyze and identify specific errors: Look for incorrect account numbers, account balances, payments reported late when they were on time, inaccurate public records, incorrect bankruptcy status, someone else’s data, accounts not belonging to you, (which might indicate identity theft), etc.
- Collect supporting documents: Gather and organize evidence clearly showing errors reflected on your credit report (i.e. bank statements with correct payment history, police reports, FTC identity theft report, letters from creditors indicating the reporting is wrong or a balance is not due, etc.)
- File a dispute with credit bureaus: Experian | Equifax | Trans Union
- Keep records of everything: Create a comprehensive file of all communications, including:
- Any correspondence you receive back from the credit bureaus or creditors with your denial for correcting the error
- Detailed notes of any phone calls, including dates, time and name of the person you spoke to

Know Your FCRA Rights
Your Right to Know When Your Credit Report is Used Against You If someone denies you credit, insurance or employment based on your credit report, they must tell you and provide the contact information for the credit agency that supplied the report.
Your Right to Free Access of Your Credit Information. You can request your complete credit file and it’s often free. You’re guaranteed a free copy if you’ve been denied credit, are an identity theft victim, have fraud-related inaccuracies, receive public assistance or are unemployed but job hunting. Everyone gets one free annual report from each major credit bureau.
Your Right to Credit Scores and Disputes . You have a right to request your credit score and dispute any incorrect or incomplete information. Credit agencies must investigate legitimate disputes and correct or remove inaccurate information within 30 days.
Your Right to Time Limits and Privacy Protection . Most negative information disappears from your report after seven years (chapter 7 bankruptcies after 10 years). Your credit information can only be shared with businesses that have a valid reason and employers need your written permission to access it.
Your Right to Additional Protections . You can opt out of pre-screened credit offers, place fraud alerts on your file or freeze your credit entirely to prevent unauthorized access. If companies violate these rules, you may be able to sue for damages.
Your Right to Seek Damages from Violators . If a consumer reporting agency or a data furnisher violates the FCRA, you may be able to sue in state or federal court.

How long do credit bureaus have to investigate a dispute?
Under federal law, credit bureaus generally have 30 days to investigate your dispute after receiving it. This requirement comes from 15 U.S.C. § 1681i(a)(1)(A), which mandates a reasonable reinvestigation of disputed information. If they fail to properly investigate or correct errors, you may have a legal claim.
Can I sue a credit bureau or creditor for reporting incorrect information?
Yes. If a credit reporting agency or data furnisher fails to follow the law (such as not correcting inaccurate information or ignoring your dispute) you may file a lawsuit under the Fair Credit Reporting Act. In successful cases, you may recover damages, attorney’s fees and potentially punitive damages for willful violations.
What qualifies as a credit reporting error?
A credit reporting error can include anything inaccurate, incomplete or outdated on your report. Common examples include accounts that don’t belong to you, incorrect payment histories, duplicate accounts or debts that should have been removed.
