A mixed credit file occurs when your credit report is combined with another person’s due to similar identifying information, such as a name, Social Security number or address. Credit bureaus rely on automated matching systems and when those systems fail, inaccurate accounts can appear on your report.

Under federal law, credit bureaus are required to investigate disputes within a specific timeframe. According to 15 U.S.C. § 1681i(a)(1)(A), they must complete an investigation within 30 days of receiving your dispute, with limited exceptions. Failure to conduct a reasonable investigation may be a violation of the Fair Credit Reporting Act (FCRA).

Yes. If a credit bureau fails to correct inaccurate information after being notified, you may have the right to file a lawsuit under the FCRA. Under 15 U.S.C. § 1681n and § 1681o, consumers may recover damages for willful or negligent noncompliance, including actual damages, statutory damages and attorney’s fees.
