Featured Verdict: $6.9M Verdict Beats Malingering Claim in Slip-and-Fall Case
Ramos Law secured a $6M+ verdict in a compelling slip-and-fall case against Kohl’s, where a customer suffered life-altering injuries after an employee removed floor decals using a slippery solvent but failed to properly clean the area or place warning signs. The incident (captured on highly persuasive video) showed the client violently falling, striking her face and head and ultimately developing a mild traumatic brain injury that led to permanent physical and psychological conditions, including visual dysfunction, occipital neuralgia and a rare functional neurological disorder.
Despite Kohl’s initially disputing responsibility for years, it admitted liability shortly before trial, shifting the battle to damages, where the defense argued the injuries were exaggerated or fabricated. Ramos Law effectively countered with a strategic mix of expert testimony, powerful day-in-the-life evidence and authentic storytelling, highlighting the client’s dramatic loss of independence and quality of life. The jury rejected the defense’s claims, instead validating the severity and legitimacy of the injuries with a substantial award for economic damages, non-economic harm and long-term impairment.
We Don’t Fall For Low-Ball Offers. We Hold Parties Accountable.
Insurance companies often use standard playbooks to offer settlements that fail to cover long-term medical needs. At Ramos Law, we use our medical and legal insight to hold negligent parties accountable and ensure your recovery is not undervalued.
If someone else’s negligence caused your fall, they should be held accountable. Period. Whether it’s a property owner who ignored dangerous conditions or a business that cut corners on safety, we fight to make sure responsibility doesn’t get swept under the rug.
We negotiate aggressively. And if they won’t do what’s fair, we’re fully prepared to take your case to court.
Types of Slip and Fall Injuries
In Wyoming, a slip and fall is a major medical event. According to 2024 state data, sprains, strains and tears account for 25.3% of all serious workplace injury cases, while fractures represent another 11.6% of incidents. At Ramos Law, we use our medical background to ensure these common but debilitating injuries are never undervalued by insurance adjusters.
We commonly see:
- Broken bones and fractures
- Traumatic brain injuries (TBIs)
- Concussions
- Back and spinal cord injuries
- Hip injuries (especially in older adults)
- Shoulder and knee damage
- Severe sprains and soft tissue injuries
Even what seems like a “minor fall” can turn into a major issue. That’s why getting the right legal and medical guidance early is so important.
Common Ways Slip and Fall Injuries May Occur in Wyoming
Wyoming’s rugged terrain and harsh winters create unique hazards. Wyoming Department of Workforce Services records show that ‘ground, travel and support surfaces’—including icy sidewalks and poorly maintained parking lots—are the source of 19.7% of all serious injury cases in the state. If a property owner failed to address these known hazards, they may be held liable for your recovery.
We frequently handle cases involving:
- Wet or slippery floors in stores and restaurants
- Uneven pavement, sidewalks or flooring
- Poor lighting in parking lots or stairwells
- Loose handrails or unsafe staircases
- Workplace hazards in construction, oil and industrial settings
Out here, we expect tough conditions. But we also expect people to act responsibly.

Does Wyoming law protect property owners regarding snow and ice hazards?
Wyoming follows the “Natural Accumulation Rule,” which generally means property owners are not liable for injuries caused by natural accumulations of snow and ice that are “open and obvious.” However, this is not a “free pass.” An owner may still be held liable if:
- Unnatural Accumulation: The owner created an “unnatural” hazard, such as a leaking gutter that created a localized ice patch or a snow pile that melted and refroze across a walkway.
- Municipal Ordinances: Many Wyoming cities, including Cheyenne and Casper, have local ordinances that require owners to clear public sidewalks within a specific timeframe.
- Failure to Exercise Reasonable Care: Once an owner attempts to clear snow or ice, they must do so in a way that does not make the surface more dangerous.
This distinction is critical because “Ground, Travel, and Support Surfaces”—which include icy walkways—account for 19.7% of all serious injuries in the state (Source: Wyoming Department of Workforce Services, 2024). At Ramos Law, we investigate the specific physics of your fall to determine if “natural” conditions were actually the result of property neglect.
What if I was partially at fault for my fall? Can I still recover anything in Wyoming?
Yes. Wyoming follows a modified comparative fault rule. That means you can still recover damages as long as you were less than 50% or less at fault. Your compensation will just be reduced by your percentage of fault. So even if you were distracted or wearing less-than-ideal footwear, you may still have a case.
Are slip and fall cases harder to win in Wyoming than in other states?
These cases can be more complex due to Wyoming’s “Natural Accumulation Rule.” Unlike some states that require property owners to clear all hazards immediately, Wyoming law generally does not hold owners liable for “natural” accumulations of snow and ice that are considered open and obvious. To win, we must prove the hazard was “unnatural”—such as an ice patch caused by a broken drain pipe—or that the owner violated a specific city ordinance.
How long do I have to file a slip and fall claim in Wyoming?
Generally, you have four years from the date of the injury to file a lawsuit in Wyoming. However, if your injury occurred on government property—such as a public building or city-maintained walkway- you must file a formal notice of claim within two years. Because evidence like surveillance footage or weather records can disappear quickly, we recommend seeking legal counsel immediately.
