Understanding Colorado Negligence & 2025 Damage Caps
Every personal injury case in Colorado involves two key legal issues: fault and damages.
Knowing how Colorado handles these questions can help you understand what your case is worth, and why having the right lawyer matters.
Comparative Negligence in Colorado
Colorado uses a modified comparative negligence rule under C.R.S. § 13-21-111. That means more than one person can share fault for an accident, including you.
If you’re partially at fault, you can still recover damages, but your compensation will be reduced by your percentage of fault.
For example:
- If you’re awarded $100,000 but found 20% at fault, your recovery would be reduced to $80,000.
- If you’re 51% or more at fault, Colorado law bars you from recovering compensation.
This rule makes insurance negotiations complicated. At Ramos Law, we fight to protect your rights and prevent insurance companies from unfairly shifting blame onto you.
Colorado’s 2025 Damage Cap Updates
Starting January 1, 2025, Colorado increased its caps on certain non-economic damages. These caps limit the amount you can recover for pain, suffering, and emotional distress.
The new limits are part of C.R.S. § 13-21-102.5 and C.R.S. § 13-21-203 for wrongful death cases.
2025 Damage Caps (Effective January 1, 2025):

These new limits apply to all general personal injury and wrongful death claims filed or accruing on or after January 1, 2025.

Separate Caps for Medical Malpractice Cases
Medical malpractice cases follow different limits under Colorado law:

Non-Economic Damages in Medical Malpractice | Up to $875,000 by 2029 |
Wrongful Death in Medical Malpractice | Up to $1,575,000 by 2029 |
These medical malpractice caps increase gradually over five years starting in 2025. They are separate from the general personal injury caps.

Colorado Personal Injury FAQ
Colorado law gives you two years to file most personal injury claims under C.R.S. § 13-80-102.
If your case involves a car accident, the deadline is three years under C.R.S. § 13-80-101.

Colorado uses a modified comparative negligence rule. This means you can still recover damages if you’re 50% or less at fault for the accident, but your compensation will be reduced by your percentage of fault.
