DaVita Lawsuit Reinforces Employee Rights

Why Is DaVita Being Sued?

The collective lawsuit claims that DaVita violated the Fair Labor Standards Act by failing to pay overtime wages and/or wages for work-related duties which occurred outside of scheduled shift hours, on weekends, and/or during lunch breaks.

According to the Fair Labor Standards Act, “employees shall be paid time and one-half of the regular rate of pay for any work in excess of: (1) forty hours per workweek; (2) twelve hours per workday, or (3) twelve consecutive hours without regard to the starting and ending time of the workday (excluding duty free meal periods).

If a DaVita employee is covered under both Colorado and federal law, the employer (DaVita) must follow the law which provides more protection to employees. The plaintiffs are seeking to recover the allegedly unpaid overtime wages, liquidated damages, interests, costs, and attorney fees from DaVita.

How Long Do I have to Join The Lawsuit?

You only have 90 days to join! Your Consent to Join must be completed and dated/postmarked no later than August 2, 2017 to join this lawsuit!

    It is important to research and know information like this. When workers’ rights have been jeopardized, the proper steps must be taken to recover compensation from the lawsuit. This is a great example on how a case like this should be handled.
