Brain Injuries & Accidents
More than 2 million people in the United States suffer a traumatic brain injury (TBI) every year. More than 50,000 people die from these injuries and another 300,000 people are hospitalized each year in the U.S. Traumatic brain injury occurs when brain function is disrupted by a blow, jolt, or penetration. A traumatic brain injury can be mild, moderate, or severe, though any type of TBI may have long-term detrimental effects.
National Brain Injury Statistics
According to the Centers for Disease Control and Prevention (CDC), 40 percent of all TBIs are caused by falls. 81 percent of all TBIs suffered by adults age 65 or older are caused by falls. The second leading cause is unintentional blunt trauma, being struck by an object, which makes up 15 percent of TBIs. Nearly a quarter of all TBIs in children under age 15 were related to blunt trauma.
Other major causes of TBI include traffic accidents and assaults. Traffic accidents making up 14 percent and 10 percent of TBIs are due to assaults. Traffic accidents are the leading cause for children and young adults aged 5-24 years. Assaults are the leading cause for children aged 0-4.

High school football is the cause for 47 percent of all reported sports concussions, 33 percent of all sport concussions happening during practice. Following football, soccer and ice hockey hold the most significant risks for TBIs.
In 2009, estimates of 248,418 children 19 years or younger were visitors of United States emergency departments for sports and recreation related injuries that included a diagnosis of concussion or TBI. The rate of emergency department visits for sports and recreation injuries with such diagnoses rose 57 percent among those children.
FAQs About CO Traumatic Brain Injury Laws
After serving brain injury victims Denver and around Colorado for many years, the Ramos Law Firm has received many questions about brain injuries and Colorado brain injury laws. To help you understand the law and the circumstances where financial recovery may be an option, we have included below some of the most commonly asked questions.
If I sustained a traumatic brain injury as a result from a slip and fall in a nursing home, could the company be held liable for my injuries?
Property owners may be held responsible if they failed their duty of meeting the standards set by safety officials including adequate lighting on their premises and the assurance that all hazardous conditions are promptly repaired or clearly rendered dangerous prior to repair. Property owners are responsible for the safety of their premises and it is their duty to ensure things like their floors are free of any substance that may cause a slip and fall.
If I suffered a TBI as a direct result of a defective product, am I able to take action against the manufacturer of the product?
If the defective product was unjustly dangerous, did not supply adequate warnings, or failed to provide complete and vivid instruction for the proper use of the product you may be able to take action against the manufacturer of the product. If the manufacturer of a product does not take great care to properly design, manufacture, and test and inspect the products they create they can be held responsible for the injuries caused by their negligence.
I suffered a TBI as a result of a traffic incident in which I was struck by a vehicle while riding my bicycle in the properly labelled lane, am I able to receive compensation for my injury?
Sudden physical damage to the brain resulting from traffic accidents and negligence of the operator of the motor vehicle may result in a personal injury settlement. Brain injuries that result from hereditary or congenital or degenerative circumstances and brain injuries induced by birth trauma, toxic chemicals, or disease-producing organisms are the only types of brain injuries that do not apply when seeking compensation for injury.
If my child sustains a concussion during football practice, what types of precaution is taken to ensure the minimal amount of damage is done?
In 2011, Colorado created the Jake Snakenberg Youth Concussion Act. This law requires public and private middle, junior, and high schools to complete an annual concussion recognition course and it is the duty of each coach of a youth athletic interscholastic activity to make sure each student completes the course.
The law also requires the student athlete to be restricted from reentering the game, competition, and practice if the athlete has sustained a concussion or if there is suspicion they have. The student may not be a participant in any team activity involving physical action until the athlete has been evaluated and received written permission from a health care professional.
If I am involved in a traffic accident that resulted in a TBI while driving the company vehicle for my employer, am I able to file for a settlement?
Yes, if you suffered a TBI during your work shift the company may be liable to pay for the damage sustained. You may be eligible for a substantial damage award. A serious brain injury may require you to have a continuing and long-term cognitive, physical, or psychological therapy which may be beyond your financial means. Also, your injuries may leave you unable to work, or reduce the efficiency of your work to a point that it limits the potential for future earnings.
